Eitan, Mehulal & Sadot represents clients in the field of maritime, aviation and shipping law, including freight import and export insurance.

We represent freight owners and insurers in claims relating to freight damage occurring in the course of the logistic chain. In addition, we represent Israeli and foreign companies in commercial disputes pertaining to international sale agreements, bills of lading, documentary credits and general interpretation of the Incoterms.

The department's attorneys are highly experienced and reputed for successfully handling disputes pertaining to maritime, aviation and shipping law in Israel, and they lecture in various forums and publish articles in the field.

 

Examples of the department's practice:

  • Claim regarding damage to marine cargo – Representation of an Israeli company in a claim against the insurance company, the shipping company and the international forwarder in respect of damage caused to a shipment that was lost on its way to South America. The court accepted our position and ruled that the insurance company is liable, by virtue of the insurance policy, for the damage caused to our client.
     
  • Claim regarding damage to air cargo – Representation of an Israeli company in a claim against the insurance company in respect of damage caused to air cargo due to temperature differences.
     
  • Claim regarding international forwarding – Representation of an Israeli importer in a claim against a foreign supplier who refused to forward to him the original bills of lading for the purpose of release of the shipment, despite the fact that the foreign supplier had received full payment.  The firm filed a motion for an injunction which led to the release of the shipment to our client.
     
  • Claim regarding damage to cargo in storage – Representation of an Israeli company in a claim against Maman and the insurance company in respect of damage caused to air cargo after the unloading thereof from the air carrier.
     
  • Claim regarding international forwarding – Representation of an importer in a claim against a personal import agent who refused to forward to him the original bills of lading for the purpose of release of the shipment.
